 CASA NOVA GIRONA RENTAL AGREEMENT.

     THIS AN EXAMPLE OF OUR RENTAL AGREEMENT, A STANDARD RENTAL AGREEMENT.  THE AGREEMENT SENT TO YOU MAY VARY A LITTLE. 

By booking and paying the initial reservation deposit the person making this booking, “the guest” accepts these terms and conditions on behalf of, and applying to, all members of the group staying at “the property” Casa Nova Girona.
The Guest undertakes to ensure that all members of the group occupying The Property are aware of these terms and conditions and that they apply equally to all members of The Party. The Guest undertakes responsibility on behalf of all members of the group.
DATE – As CasaNovaGirona  online booking confirmation on reservation deposit payment.
INVOICE / CLIENT NUMBER – As per CasaNovaGirona online booking information.
AGREEMENT BETWEEN  - PROPERTY OWNERS - CHRIS AND GILL COLVERSON. BRUNYOLA 17441. GIRONA. CATALUNYA.    RENTAL GUESTS -  As CasaNovaGirona online booking, named rental guest, principal rental guest.
RENTAL / HOLIDAY DATES, As per CasaNovaGirona online booking request and confirmation.
TOTAL NUMBER OF PEOPLE, As per CasaNovaGirona online booking request and confirmation.           
 
MAKING YOUR BOOKING – To book Casa Nova Girona you are required to make the booking and payment as specified on the CasaNovaGirona website, within the specified time periods, or as agreed with the owner in writing. The booking is confirmed once the initial reservation deposit has been paid and you have accepted the rental agreement.
Please carefully check all details on your booking confirmation and subsequent correspondence, and inform us immediately of any errors or emissions. Thank you.
PAYMENT TERMS – We accept payment through CasaNovaGirona website, as specified online, or as agreed directly with owners and verified in writing.  We require a 10% deposit to confirm reservation, with the main balance and security deposit due 5 weeks prior to your occupancy as specified in your CasaNovaGirona quote.
If you fail to make a payment due to us in full or on time, we may treat your booking as cancelled by you.
CANCELLATIONS – If you need to cancel or to amend your booking you must telephone or email us as soon as possible.  A cancellation or amendment will not take effect until we receive confirmation in writing or via email from you.
Cancellations made within 60 days of occupancy will attract a 10% cancellation fee, the initial reservation deposit payment.    Early departures – no refunds will be made.
Following the covid pandemic we are striving to remain as flexible as possible with all reservations if you need to cancel.  Please ask to see our full rental agreement concerning Force Majeure.
If we cancel or amend your booking – we do not expect to make any changes to your booking, but sometimes issues can occur, such as Acts of God. If this does happen we will contact you as soon as possible and endeavour to assist as much as possible. If we do need to cancel your booking we will return any fees paid to us.  However we will not be liable to refund you for any fees that you may have paid to any third party in connection with your holiday, including travel, insurance, entertainment etc.
SECURITY / DAMAGE DEPOSIT –  A security / damages deposit of 400 euros is required, as stated in the CasaNovaGirona quote and invoice, due at the time of the main balance, preferably paid through Paypal. Refundable.
This security deposit is not applied towards rent and is fully refundable provided the following provisions are met
            No damage is done to the house, contents or grounds beyond normal wear and tear.
            No charges are incurred due to services rendered during your stay, illegal activities, pets or collection of rent.
            All debris, rubbish and discards are removed, to the recycle bins, as advised in the House Information Book.
            The house is left in good order, as you found it on arrival, ready to be cleaned for the following guests.
            No linen, towels, soft furnishings, house contents etc lost or damaged.
            All keys etc to be left as instructed by the owners.
            The renter is not evicted by the owner, or representative of the owner or the local law enforcers.
We do have to remind you that this is a private house and we appreciate if you can look after our house and contents and to leave it in good order. Please clear out the fridge removing all opened and part used foods and bottles, stack last minute soiled dishes in the dishwasher, tidy toys and games away, return any moved indoor and outdoor furniture etc, ready for the house to be cleaned.  We regret but there will be a charge if the house is left in a bad state, rubbish not removed, fridges not cleared out, or left in a condition requiring additional cleaning, etc.
ADDITIONAL CHARGES – Any food, shopping or other required, payable in local currency, euros, cash to the owners.
Repairs – The rental client will be subject to a call out charge and a possible damages bill for matters due directly to the client’s negligence beyond reasonable wear and tear. This includes loss of keys, refilling the swimming pool if glass is broken within the pool or fenced pool area, or as per security damage deposit information. 
SECURITY DEPOSIT REFUND – CasaNovaGirona will refund the security deposit after your departure, once the house has been cleaned and checked, unless there is any specific damage that we need to bring to your attention.
DAMAGE – We ask guests to please report any damage to the property, contents or grounds, so they can be repaired or replaced as soon as possible for your comfort and if possible before the next guest’s arrival – any malfunctions with equipment, smoke alarms that emit a beep, fire extinguishers or fire blankets used, failed light bulbs, leaking taps etc. We will try to replace or to repair as soon as reasonably possible.
The owner will not be responsible nor liable to the client for any temporary defects or stoppages in supply of water, electricity or public services to the property or for any loss or damage or injury from adverse weather conditions, losses due to lightening strikes or other Acts of God beyond the control of the owner.
The tenants / guests are hereby notified that we are not liable for any injury to or damage due to their belongings during their stay, that the owner cannot be held responsible for any accidents, break-ins or theft within the property. All vehicles are also left entirely at the Guest’s risk.
SECURITY / TRAVEL INSURANCE – We recommend that you take out adequate travel / holiday insurance for your trip. Guests are advised to see to their own security while in the property, shutting & locking doors and windows as appropriate. 
INCLUSIVE FEES – Our rental rates include local taxes, a one time linen and towel setup, cleaning prior to your occupancy, gasoil, electricity, gas bottle, some wood for the wood burning stove, and basic items to get you started.
 
SWIMMING POOL AND BICYCLES – The swimming pool is fenced with a locking gate for your safety. The tenants / guests agree to have a responsible adult supervising minors whilst in the swimming pool or pool area and hereby are notified that the pool can be dangerous and they accept fully the risks involved. 
The masia currently has some adult bicycles for your use. We ask that you please look after them and to let us know of any damage or maintenance required. We do not supply bicycle safety equipment, as helmets etc are an individual requirement. Please bring any necessary safety equipment.  We hereby notify guests that bicycles can be dangerous and that they fully accept the risks involved and understand that they are responsible for their own safety equipment such as helmets.
 
MAXIMUM OCCUPANCY – The maximum number of guests must not exceed those detailed in the CasaNovaGirona booking information, unless as agreed in writing with the owner prior to occupancy. A charge will be made for additional guests not included on the original quote and invoice.
FALSIFIED BOOKINGS / SUBLETS – Any bookings obtained under false pretence, or third parties subletting either part or the whole house will be subject to forfeiture of advance payment deposit and/or rental money, and the party will not be able to check in.
 
PETS – We accept pets, but please do ask.  Guests are asked not to leave their pets unattended in our house, (please don’t go out and leave your pets alone in our house), not to let them on the beds, to clear up after them, and to be responsible for their pets, our house and garden. 
SMOKING – We do allow smoking, but ask that you smoke outside, please don’t smoke upstairs or in any of the bedrooms.
Please be careful of cigarette butts, ashtrays are provided, and don’t flick them into our garden, plants pots or by the car – we have had an issue with a cigarette butt smouldering in a planter in April !!  Thank you for your consideration.
 
MAINTENANCE – At times we will need access to the house and garden to clean the pool, cut the grass, check that watering and pool pump systems are working, or for essential repairs within the house. We will respect your privacy as far as possible.
TOILETS, SINKS & DRAINS – The Guests are responsible for ensuring that toilets, sinks and drains are not blocked – that no nappies, wet wipes, other wipes or sanitary items are flushed down the toilets, and no fat, oil or grease is poured down the kitchen sink or other drains.  The house has it’s own septic tank and we thank you for your consideration. 
WATER - The house has it's own wells and bore hole. We ask that you please help us to save water for all our comfort - please don't leave taps running, fully load the dishwasher and washing machine, flush the tolets only when required, take short showers, make sure that the pool shower is switched off.  We thank you for your consideration.
The house is supplied by well water. We use the water to shower, clean our teeth, cook with, make hot drinks with. Our water is good, but as a precaution we recommend that you use bottled water for cold drinking water.  There will be a large bottle of water in the fridge for your arrival. 
There is constant hot water, combi boiler.
RUBBISH – The Guests are responsible for all their rubbish, to take all away to the re-cycle bins. We have no door to door rubbish collection in rural Catalunya, so take all rubbish to the nearby recycle bins.  Please don’t leave rubbish outside, in the heat, or where bags can be raided by animals or insects.  Please take all nappies and bedroom bin rubbish to the bins. 
FIRE EXTINGUISHERS / SMOKE ALARMS ETC - The house is equipped with many smoke/heat alarms, fire extinguishers, fire blanket etc. Each bedroom, the house information book and information noticeboard have a "Fire Escape Plan" for each room and the house as a whole.  We ask that you familiarise yourself with it. 
OWNERS - So that you are fully aware, as stated on our website and all adverts, we the owners live on the estate and service the house and grounds.  We have no direct view of the masia, walled garden, pool and bbq areas and will respect your privacy. But we are available, if you wish, for any help or information.
 
ARRIVAL & DEPARTURE TIMES –
WEEKEND ARRIVAL AND DEPARTURE TIMES - CHECK-IN AFTER 12.00 HOURS, (12 midday).  CHECK-OUT BY 18.00 HOURS, (6pm)
SUMMER AND WEEKLY RENTALS - WE TRY TO BE AS FLEXIBLE AS POSSIBLE DEPENDING ON YOUR TRAVEL PLANS OR FLIGHT TIMES.  PLEASE ASK TO SEE WHAT IS POSSIBLE, DEPENDING ON PREVIOUS OR FOLLOWING RENTAL GUESTS. 
Please can you let us know of both your intended arrival time and departure time, so we know when to expect you, and know when you are leaving.  If you have a very early flight arrival please contact us to ask if an earlier arrival time is possible.   If your flight is delayed we can check flight radar so that we know when toexpect you.
DIRECTIONS – We will send, by email or whatsapp, full directions to you after the main balance payment.
ARRIVAL – We will meet you at the house, on your arrival.
PARKING – Please park between the trees, on the left, as you arrive at the house, nose or boot in.
ON YOUR ARRIVAL – Please can you have your passport ready for us to take details from, for all people over 16 years of age, as registration, to comply with Catalan tourism regulations.  We will need to know who is staying on which days and for how long.  
THIS PROPERTY is registered as an official holiday rental property – rental number HUTG 025025.  
I / We have read the above agreement and accept the terms and conditions in the information provided and accept the online rental agreement on the CasaNovaGirona website.. I/We accept that my/our booking is for the rental period, date and number of people stated in the CasaNovaGirona booking form, and I/We agree to leave the property in a clean and tidy condition at the end of our stay.
